The Internal Revenue Service has shifted its focus from processing Employee Retention Credit (ERC) claims to actively examining and challenging previously filed credits. As ERC audits increase, tax practitioners are required to defend eligibility determinations, factual support, and credit calculations—often years after the original claim was submitted and under evolving IRS guidance.

This two-hour continuing education program provides tax professionals with a practical framework for navigating an ERC audit from initial IRS contact through resolution. The course examines current ERC eligibility standards as applied by the IRS, outlines the Service’s present enforcement priorities, and explains the structure and progression of an ERC examination, including common audit notices and Information Document Requests (IDRs).

Participants will learn how to assemble, evaluate, and defend ERC claim documentation, address weaknesses in inherited or third-party-prepared claims, and manage both taxpayer and practitioner risk. Emphasis is placed on real-world audit strategy, documentation organization, and effective responses to IRS inquiries in today’s heightened enforcement environment.

Learning Objectives

Upon completion of this course, participants will be able to:

  1. Identify ERC eligibility requirements as currently applied by the IRS in examination and enforcement actions.
  2. Describe the IRS’s current ERC audit focus areas, selection trends, and enforcement priorities.
  3. Explain the ERC audit process, including initial notices, IDRs, and procedural timelines.
