Can one spouse file an Offer on a joint tax liability if the other does not want to participate?

Yes, if only one spouse wants to file an Offer-in-Compromise they can without the other spouse. The Offer will be treated as discussed in #28 above: joint expenses will be allocated, and the assets will be treated in line with the state\’s laws of property ownership (separate property or community property). Note, because one spouse is tolling the collection statute by filing the offer, the IRS will separate the assessment from the date of the offer filing so 1) the collection statute is not tolled for the non-filing spouse and 2) the IRS can continue collection efforts against the non-filing spouse.
