What if the client’s income swings up and down so there is no clear picture of their normal level of income?

The IRS will try and come up with a three-year average. IRM 5.8.5.20 states that when taxpayers have either irregular or fluctuating income, the Offer Specialist should average earnings over the three prior years.
What the Offer specialist often fails to do is adjust the income taxes accordingly, which they must do to be fair. If the taxpayer were earning a certain level of income, they would have to pay an appropriate level of tax.
