Can you amend a Protective Claim after you have filed it?
A protective claim may be amended after the statute of limitations has expired, but only to clarify or provide additional information related to the original grounds stated in the timely claim. If the amendment introduces new grounds or requires investigation of new matters not disclosed by the original claim, it will be treated as a new (and potentially untimely) claim. ECC 200848045
