Can the IRS levy retirement accounts?

Yes, the IRS can levy retirement accounts such as IRAs or 401(k)s,but only if the taxpayer has the legal right to access the funds. Unlike other creditors, the IRS is not restricted by ERISA (Employee Retirement Income Security Act) protections. The IRS is said to st6ep into the shoes of the taxpayer, so it can reach by levy whatever the taxpayer could have accessed themselves.
