IRC 7203 covers willful failure to pay tax file a required return keep records or supply information It is a misdemeanor punishable by a fine up to 25000 100000 for corporations imprisonment up to 1 year or both plus prosecution costs If the violation involves 6050I the offense is elevated to a felony with up to 5 years imprisonment The section does not apply to failures to pay estimated tax if no addition to tax is imposed under 6654 or 6655
