Is money in a 529 account includible as an asset for an Offer?

It depends upon the source of the funds. If the money was transferred from the taxpayer(s) that owes the tax debt, then the money will be considered available. If the money was received by the child from third parties as gifts or inheritances, then it should not be considered available. The burden will be on the taxpayer to prove the source of the funds.
