IRC 6343 – Levies Must be Released if Causing Hardship

The IRS must release a levy on all or part of a taxpayers property and promptly notify the person upon whom the levy was made if any of the following conditions are met The tax liability is satisfied or becomes unenforceable due to the lapse of time Releasing the levy will facilitate collection of the liability The taxpayer has entered into an installment agreement under section 6159 to pay the liability unless the agreement states otherwise The levy is causing economic hardship due to the taxpayers financial condition The fair market value of the property exceeds the liability and releasing part of the property will not hinder collection For essential business property the IRS must provide an expedited determination if the levy would prevent the taxpayer from carrying on their trade or business Releasing a levy does not prevent the IRS from making a subsequent levy on the same property
